TERMS AND CONDITIONS OF USE – OPUSCLICK

1. Purpose of the Service

OpusClick (hereinafter, the “Platform” or “OpusClick”) enables employers (companies or professionals with a VAT number) to publish job offers and candidates to browse them and submit applications. Use of the Service is subject to acceptance of these Terms and Conditions (“T&C”).

2. Registration and User Types

Employer: Publishes job posts, manages applications, contacts candidates.
Candidate: Creates a profile, uploads a CV and applies for job posts.

To register, users must provide truthful, complete and up-to-date information. Credentials are personal and non-transferable. OpusClick may suspend accounts that show suspicious activity, violations, or false data.

3. Permitted Use

Users agree to use the Platform exclusively for lawful professional purposes and to refrain from:

• Publishing defamatory, discriminatory, obscene or deceptive content.
• Infringing third-party rights (trademarks, copyright, privacy, etc.).
• Sending spam or contacting other users for purposes unrelated to the job offer.
• Injecting malware, attempting unauthorised access or disrupting the Site’s operation.

4. User-Generated Content

Each User remains responsible for the content they upload (posts, company descriptions, CVs, messages). By publishing content, the User grants OpusClick a non-exclusive, royalty-free, transferable licence to display such content on the Platform. OpusClick may remove material that violates these T&C or applicable law.

5. Paid or Premium Services

5.1 Description of Premium Services

In addition to free services, OpusClick may offer paid features such as:

• Job Post Promotion (greater visibility on the homepage or in search results).
• Advanced Database Access (extended CV database, advanced filters).
• Corporate Branding (custom company pages, highlighted logo).
• Analytics & Reporting (candidate statistics, sector benchmarks).

5.2 Subscription and Payment

Prices, duration and specifications of each Premium Service are listed on the relevant purchase page.

Payment is made in advance using the methods indicated (e.g., credit card, bank transfer, PayPal).

Unless cancelled within the stated period, subscriptions with automatic renewal will renew under the same financial terms unless otherwise notified.

5.3 Withdrawal and Refunds

Unless otherwise required by law or specified in special conditions, digital services are non-refundable once activated, as they are immediately available. Any exceptions will be assessed on a case-by-case basis.

6. Service Availability

While OpusClick follows best practices to ensure operational continuity, it does not guarantee the absence of interruptions or errors. The Platform may be temporarily suspended for maintenance or force-majeure reasons.

7. Limitation of Liability

OpusClick is not a party to employment relationships between Users and does not pre-screen job posts or CVs for accuracy. Therefore, OpusClick shall not be liable for:

• The accuracy, completeness or legality of information published by Users.
• The outcome of recruitment processes or contracts concluded.
• Direct or indirect damages arising from use of the Site or the inability to access it.

8. Privacy and Cookies

Personal data are processed in accordance with the Privacy Policy and Cookie Policy available on the site, which the User declares to have read and accepted.

9. Account Cancellation, Deactivation and Closure

9.1 Voluntary Cancellation

Users may request permanent closure of their account at any time via the profile function or by emailing support@opusclick.it.

The request will be processed within 30 days; residual data will be handled as required by current regulations and the Privacy Policy.

9.2 Suspension or Removal by OpusClick

OpusClick may suspend or delete an account without prior notice in cases of:

• Material breach of these T&C or of the law.
• Publication of fraudulent or harmful content.
• Activities that damage the integrity or security of the Platform.

9.3 Effects of Cancellation

All posts and data linked to the account will be deleted or anonymised, except where retention is required by law.

Active Premium subscriptions are not eligible for refunds for any remaining prepaid period, unless agreed otherwise in writing.

10. Amendments to the Terms

OpusClick may update these T&C at any time. Changes take effect from the date of publication on the Site. Continued use of the Platform constitutes acceptance of the new terms.

11. Governing Law and Jurisdiction

These T&C are governed by Italian law. Any dispute shall fall under the exclusive jurisdiction of the Court of Novara, unless otherwise mandatorily provided by law.
